To me this mean that you are in trouble if you are re-using data from the ODP.
Copyright matter and easy to check, so I would not play with this, especially knowing how much Google likes this project.

Obviously, submitting and getting accepted is a real good thing for any web site. It's quite understandable they do not want to be copied
